solved:

seems i used a p2p emulator to crack it and its either getting deleted or was deleted before i packaged it up for release, or maybe it was just faulty.
either way i posted a crackfix above what will correct it. simply unrar it to your game folder.

its very strange that nobody reported it until now, so thanx
