Shogun 2 Windows 8 issue

hey guys
Recently i downloaded the KaoS shogun 2 fall of the samurai rip, and ive used this version on windows 7 before with absolutely no issues and the same antivirus protection ( comodo internet security )
i have enabled all necessary files through my security, i have excluded all necessary files during installation
Basically what happens is, the game launchs, gets to the loading screen. begins to load, and just before the menu, it crashs. with a simple "the program has crashed" and a close option
I have tried the following
Unraring and unpacking manually
Update/packs other cracks
Installing into differently named folders and the default c:/games/name path
Windows 7 compatability mode
installing all the drivers from extra
There's only 2 causes i can see for this issue
1. The Crack/EXE has an issue with windows 8
or
2. When unpacking, the unpacking doesnt finish due to windows 8 shell coding changes. i did notice that at the end of the batch file, its meant to but the file remains in the folder and isnt deleted. so im starting to think maybe something isnt being unpacked properly and the batch file needs to be looked at for windows 8
i did look around, and found that there is a log saved in appdata/roaming called modified.log, im not sure if it will help, but it outputs the following
