Update to this story. It now seems that some sort of out-of-court settlement may have taken place as the updated comment added to the previous article says this -

"Updated: VMProtect developer stated that the conflict with Denuvo Software, which was noticed by users of NeoGAF and Reddit , has lost its relevance."

Further to this story VMProtect Software have now just issued this statement in their blog -

"We were informed that there are open questions and some uncertainty about the use of our software by DENUVO GmbH.
Referring to this circumstance we want to clarify that DENUVO GmbH had the right to use our software in the past and has the right to use it currently as well as in the future.
In summary, no open issues exist between DENUVO GmbH and VMProtect Software for which reason you may ignore any other divergent information."


So looks like VMProtect will continue to be a component of Denuvo's malware.
